Building a House on Your Bengaluru Plot: When Labour-Only Contracts Are GST-Exempt
Karnataka's advance ruling authority, in KAR.ADRG 20/2026 dated 16 March 2026, held that pure labour contracts for original works on a single residential unit, not part of a residential complex, are exempt from GST under entry 11 of Notification 12/2017. What plot owners building a house should check.
A family in north Bengaluru owns a 30 by 40 site and is ready to build. One contractor quotes a single price for labour and materials. Another, a labour contractor, offers to supply only the masons, carpenters and helpers while the family buys cement, steel and tiles themselves. The second quote comes without GST. Is that legitimate, or a corner being cut? A ruling signed in Bengaluru on 16 March 2026 answers that question for one labour contractor, and the reasoning is useful for anyone building an independent house in the city.
The ruling is Order No. KAR.ADRG 20/2026 of the Karnataka Authority for Advance Ruling, given to a Bengaluru labour contractor, M/s House Construct Infra of Laggere, and listed on the GST Council's advance ruling register. This guide reads it for a plot owner planning construction. It is buyer guidance, not tax advice, and an advance ruling answers one applicant's question on its own facts.
The short answer. The Karnataka authority ruled that services by way of pure labour contracts for construction, erection, commissioning or installation of original works pertaining to a single residential dwelling unit, otherwise than as a part of a residential complex, are exempt from GST under entry 11 of Notification No. 12/2017-Central Tax (Rate). It set four conditions: a pure labour contract with no transfer of property in goods, construction-type activity, original works, and a single residential unit not forming part of a residential complex. The trade-off: a labour-only contract can keep GST off the labour bill, but you then buy and manage materials yourself, and the exemption does not extend to apartment buildings or residential complexes.
What did the Bengaluru ruling decide?
That the contractor's service is exempt, subject to conditions. The applicant supplies pure labour services to individual owners of single residential dwelling units, does not supply any material, and does not provide services to residential apartments, residential complexes or housing projects. It asked about the taxability of pure labour services to single stand-alone residential dwelling units.
The ruling says that services by way of pure labour contracts for construction, erection, commissioning or installation of original works pertaining to a single residential dwelling unit, otherwise than as a part of a residential complex, are exempt from GST in terms of entry 11 of Notification No. 12/2017-Central Tax (Rate) dated 28 June 2017, as amended. It adds that this is subject to the conditions that the activity qualifies as original works, the residential unit is a single stand-alone dwelling unit, and it does not form part of a residential complex.
What does entry 11 actually say?
The ruling reproduces it. Entry 11 of Notification No. 12/2017-Central Tax (Rate), under Heading 9954, covers services by way of pure labour contracts of construction, erection, commissioning or installation of original works pertaining to a single residential unit otherwise than as a part of a residential complex. In the rate column it shows NIL, and in the conditions column it also shows NIL.
The authority added its own reading of the phrase. It said the entry covers services where the supplier undertakes only labour-oriented activities, without any supply of goods or materials, in relation to original works of a single residential dwelling unit. It also noted at the outset that the Central and Karnataka GST Acts are pari materia and contain identical provisions on material aspects, so its references to the CGST Act also apply to the corresponding provisions of the KGST Act.
What counts as a pure labour contract?
One with no materials. The authority listed the essential ingredients of the entry. The service must be a pure labour contract, meaning there is no transfer of property in goods and no material is supplied by the service provider. The activity must relate to construction, erection, commissioning or installation. It must pertain to original works. And it must be provided for a single residential unit not forming part of a residential complex.
In practice, that is why the opening example matters. If the contractor's quote includes cement, steel or any other material, it is not a pure labour contract within the ruling's description. If the family buys all materials and the contractor supplies only labour, the first condition is met.
| Condition in the ruling | What it means for a Bengaluru plot owner |
|---|---|
| Pure labour contract, no transfer of property in goods | The contractor supplies no material at all |
| Construction, erection, commissioning or installation | The work builds or installs, rather than only maintaining |
| Original works | New construction, specified additions and alterations, or first-time installation |
| Single residential unit | A self-contained unit designed for use, wholly or principally, for residential purposes for one family |
| Not part of a residential complex | Not in a complex of buildings with more than one single residential unit |
What are original works and a single residential unit?
The ruling quotes the definitions in the notification. Original works means all new constructions, all types of additions and alterations to abandoned or damaged structures on land that are required to make them workable, and erection, commissioning or installation of plant, machinery or equipment or structures, whether pre-fabricated or otherwise.
A single residential unit means a self-contained residential unit which is designed for use, wholly or principally, for residential purposes for one family. A residential complex means any complex comprising a building or buildings having more than one single residential unit. The ruling says the exemption does not extend to services provided for apartment buildings, housing projects or residential complexes comprising more than one dwelling unit with common infrastructure and shared facilities.
Repairs and later additions need care. The ruling's quotation of original works covers all new constructions and additions and alterations to abandoned or damaged structures on land that are required to make them workable. Routine repair or renovation of a lived-in house is not one of the listed categories. If you are adding a floor or renovating years later, the treatment of that later contract is a separate question to raise with your adviser.
Does a house in a gated plotted layout qualify?
The ruling does not answer that directly. It describes the applicant's work as confined exclusively to stand-alone residential dwelling units, rendered independently and not linked to any residential complex or project. It also says the words otherwise than as a part of a residential complex clearly exclude services for apartment buildings, housing projects or residential complexes with common infrastructure and shared facilities.
If your plot is in a gated layout with shared amenities, ask your contractor and tax adviser whether your house is treated as part of a residential complex before relying on the exemption. Our guides to GST when you buy a developed plot and to which authority approves a Bengaluru plot cover the steps before construction begins. When comparing plotted projects such as Adarsh Springfield plots on Sarjapur Road, ask how the layout and its common facilities are structured.
Should I choose a labour-only contract?
That is a practical decision, not a tax one. A labour-only contract can keep GST off the labour portion, but it shifts the work of buying, storing and checking materials to you, and it changes who is responsible when materials are wasted or below specification. A combined contract simplifies supervision but falls outside the pure labour exemption described in the ruling. Compare the total cost of each route, including your own time and the risk of material wastage, rather than the tax line alone.
If you are taking a construction loan, your lender's requirements on plans and stage-wise disbursal also shape the contract. Our guide to construction loans on your own plot covers the RBI rules on that.
How should a labour-only contract be written?
Plainly, and in line with the facts the ruling relied on. The applicant in the Karnataka case described its work as supply of pure labour services, with no material whatsoever and a scope strictly restricted to labour. If you choose this route, the contract you sign should say the same thing: the contractor supplies workers and supervision of those workers, and you supply all cement, steel, sand, bricks, tiles, fittings and other materials.
Keep the paperwork consistent with that description. Material invoices should be in your name and paid from your account. Labour bills should describe labour only. If the contractor later starts buying materials on your behalf and billing them, the arrangement on the ground no longer matches a pure labour contract, and the exemption the ruling describes may not fit. Settle this before work starts rather than midway through construction.
A seven-point checklist before signing a house construction contract
- Decide whether you want a labour-only contract or a combined labour and materials contract.
- If labour-only, make sure the contract states that no material is supplied by the contractor.
- Confirm the work is new construction or another form of original works.
- Confirm the house is a single residential unit for one family.
- If the plot is in a gated layout, ask whether it is treated as part of a residential complex.
- Ask the contractor for the GST position in writing, citing the entry relied on.
- Keep invoices for materials you buy separately from the labour bills.
