Buying the Flat You Rent in Mumbai: RBI Rules on Tenant Loans and Repair Top Ups

RBI's April 1, 2025 Master Circular on Housing Finance lists loans to a person buying an old house where they live as a tenant among permitted housing loans, and allows banks to consider repair and addition finance within the overall ceiling, or against a pari passu or second charge. This guide shows Mumbai tenants how to prepare.

A Mumbai family has rented the same one bedroom flat for nine years. The landlord now wants to sell, and offers it to them first. They know the building, the neighbours and every crack in the bathroom tiles. What they do not know is whether a bank will lend to a sitting tenant buying an old flat, and whether they can borrow again later to fix those tiles and the ageing wiring.

Both questions have answers in a single Reserve Bank of India document. This guide explains what RBI's housing finance circular says about loans to tenants buying the house they live in, top up finance for repairs and additions, and loans where another lender already holds a mortgage. It is buyer guidance on loan eligibility rules, not a promise that any particular bank will lend.

The short answer. RBI's April 1, 2025 Master Circular on Housing Finance lists finance to a person who proposes to buy an old house where he is presently residing as a tenant among the housing loans banks may extend. It also says banks may consider additional finance within the overall ceiling for alterations, additions or repairs to a house or flat they already financed, and may lend to people with loans elsewhere after taking a pari passu or second mortgage charge. The trade-off: the circular permits these loans but does not oblige any bank to grant them, so your own eligibility, the flat's documents and the bank's ceiling decide the outcome.

What does RBI say about tenants buying their rented home?

It is listed as a permitted purpose. Paragraph 2(B) of the Master Circular, on construction of buildings and ready built houses, sets out the kinds of housing finance banks may grant. Item (iv) says banks may extend finance to a person who proposes to buy an old house where he is presently residing as a tenant.

The same list includes loans to individuals for purchase or construction of a dwelling unit per family and loans for repairs to damaged dwelling units. So a tenant buying an older Mumbai flat is not outside the framework; it is one of the named cases. Whether a particular bank lends is a separate question, decided by its appraisal of your income, the flat's title and approvals, and its own credit policy.

What checks will still apply to an old flat?

The same ones that apply to any ready built property. The circular says that where an applicant seeks a loan to purchase a built up house or flat, it should be mandatory for the applicant to declare by affidavit-cum-undertaking that the property has been constructed as per the sanctioned plan and/or building bye-laws and, as far as possible, has a completion certificate. It adds that an architect appointed by the bank must certify, before disbursement, that the property is strictly as per the sanctioned plan and/or building bye-laws.

For an older building, gathering those papers can take time. As a tenant you may never have seen the building's approved plan. Ask the landlord early for the title chain, the society share certificate if the building is a co-operative society, and whatever plan and completion documents exist. Our guide on why a Mumbai sale deed needs to be registered covers the registration step that follows once the loan is in place.

Can you borrow again later for repairs and additions?

Within limits. Under the heading Supplementary Finance, the circular says banks may consider requests for additional finance within the overall ceiling for carrying out alterations, additions or repairs to the house or flat already financed by them. The phrase within the overall ceiling is the key limit: a top up is meant to sit inside the bank's lending limits on that property, not on top of them.

The circular separately says banks may grant finance to owners of a building, house or flat, whether occupied by themselves or by tenants, to meet need based requirements for repairs or additions. It says they should do so after satisfying themselves about the estimated cost, for which a certificate should be obtained from an engineer or architect wherever necessary, and after obtaining such security as they deem appropriate.

What do pari passu and second charge mean for you?

The circular uses two terms that are worth decoding. A pari passu charge means two lenders share security over the same property with equal ranking. A second charge means the new lender's claim ranks after the existing lender's. In both cases, more than one lender has an interest in your flat, and the paperwork will usually involve both of them.

For a Mumbai owner who bought with one lender and later wants repair money from another, the circular gives the second bank room to lend on that basis, or against other security it considers appropriate. Before you apply, ask your existing lender what it requires before another charge can be created over the flat, and get that answer in writing. Treat a second charge as a commitment that may need to be cleared before any future sale.

How do the loan options compare?

The table maps each situation to what the circular says and the practical question to put to your bank. The first two columns restate the circular; the last three are buyer steps.

What should a tenant negotiate before agreeing to buy?

Time, mostly. Because the bank's architect has to certify the flat before disbursement, and because older buildings can take longer to document, a tenant buyer should agree payment dates that run from loan disbursal rather than from signing. A landlord who has had a reliable tenant for years may be open to that.

Also get a clear statement of what is being sold: the flat, any parking right, and any society membership transfer. If the landlord has an existing home loan on the flat, ask how and when that lender will release the original documents. The circular's fair lending section points banks to RBI's September 13, 2023 instructions on release of property documents on repayment, and our Mumbai explainer on how quickly a lender must return original property documents after closure covers the timelines on that side.

A seven-point checklist for Mumbai tenants and renovators

  1. Ask the landlord for the title chain, share certificate if any, and the building's plan and completion papers.
  2. Ask your bank whether it lends to sitting tenants buying an old flat, and what it needs from you.
  3. Agree payment dates with the landlord that run from loan disbursal, not from signing.
  4. Before planning renovation, ask your bank how much headroom your loan leaves under its overall ceiling.
  5. Get a written repair estimate and, where your bank asks, an engineer or architect certificate on cost.
  6. If another lender already holds a mortgage, ask both lenders about a pari passu or second charge.
  7. Keep every repair invoice and certificate with your loan file for later queries.

Which lenders does this circular cover?

The circular says it applies to all scheduled commercial banks, excluding regional rural banks. It also states that it only consolidates instructions issued up to March 31, 2025 and contains no new instructions. RBI's website now also carries the Commercial Banks Credit Facilities Directions, 2025, which the site shows as updated on October 1, 2026. If you are borrowing from a housing finance company or a co-operative bank, this circular does not apply to it, so ask that lender which rules and policy it follows.

The practical message for a Mumbai tenant is simple. The rulebook does not stand in your way; documents and timing usually decide how smoothly it goes. Start the paperwork conversation with your landlord and your bank in the same week, and you will know early whether the purchase, and the renovation after it, can be financed the way you hope.

Frequently asked questions

Can a tenant get a bank home loan to buy the flat they live in?

Yes, in principle. RBI's April 1, 2025 Master Circular on Housing Finance lists, among the housing loans banks may extend, finance to a person who proposes to buy an old house where he is presently residing as a tenant. Approval still depends on the bank's own appraisal of you and the property.

Can I borrow more later to renovate a flat my bank already financed?

The circular says banks may consider requests for additional finance within the overall ceiling for carrying out alterations, additions or repairs to a house or flat they have already financed. The words within the overall ceiling matter, so ask your bank how much headroom your existing loan leaves.

What if another lender already holds the mortgage on my flat?

The circular says that where individuals raised funds from other sources and need supplementary finance, banks may extend it after obtaining a pari passu or second mortgage charge over the property mortgaged to the other lenders, or against other security the bank deems appropriate.

Do repair loans need any engineer or architect certificate?

For finance to owners for need based repairs or additions, the circular says banks should satisfy themselves about the estimated cost, for which a certificate should be obtained from an engineer or architect wherever necessary, and should obtain such security as they deem appropriate.
