Your Rights as a Home Loan Applicant: RBI's Fair Practices Code for Bengaluru Buyers

RBI's Fair Practices Code guidelines, in its July 1, 2015 Master Circular on loans and advances, say lenders should acknowledge applications, disclose all fees and the all in cost, give rejection reasons in writing, furnish the loan agreement with enclosures, apply changes only prospectively and answer takeover requests within 21 days. A Bengaluru buyer applies for a home loan in September, pays a processing fee and hears nothing for three weeks. Then a one line message arrives: the application has been declined. No reason, no explanation, no word about whether the fee comes back. The buyer has a booking deadline with the builder in ten days and no idea what to fix before applying elsewhere.

That silence is exactly what RBI's Fair Practices Code for lenders was written to prevent. This guide explains what the code says about loan applications, rejections, charges, loan documents and takeover requests, and how a Bengaluru buyer can use it while shopping for a home loan. It is buyer guidance on borrower rights, not a guarantee of how any particular bank will respond.

The short answer. RBI's Fair Practices Code guidelines, set out in paragraph 2.5 of its July 1, 2015 Master Circular on Loans and Advances, Statutory and Other Restrictions, say lenders should acknowledge every loan application, disclose all fees and the all in cost upfront, convey the main reasons for rejection in writing for loans of every size, give borrowers a copy of the loan agreement with all enclosures, make rate and charge changes only prospectively, and respond to a takeover request within 21 days. The trade-off: these are guidelines banks must build into their own board approved codes, so the exact timelines and processes vary by lender, and your first step is always to ask for the bank's code in writing.

What does the Fair Practices Code cover?

The whole life of a loan, from application to closure. Paragraph 2.5 of the Master Circular says the guidelines were finalised after examining recommendations of a government working group on lenders' liability laws, and that banks are advised to adopt them and frame a Fair Practices Code approved by their boards. The circular is addressed to all scheduled commercial banks, excluding regional rural banks.

The guidelines are grouped under five headings: applications and their processing, loan appraisal and terms, disbursement including changes in terms, post disbursement supervision, and general conduct. RBI's April 1, 2025 Master Circular on Housing Finance separately tells banks to follow these fair practices code guidelines, as amended from time to time, in its section on fair lending practices.

What must a bank tell you when you apply?

Everything that affects your cost. The guidelines say banks must transparently disclose to the borrower all information about fees and charges for processing the loan application, the amount of fees refundable if the loan is not sanctioned or disbursed, prepayment options and charges, penalty for delayed repayment, conversion charges for switching between fixed and floating rates, any interest reset clause, and any other matter that affects the borrower's interest.

They add that levying charges later without disclosing them is an unfair practice, that all processing fees and charges should be disclosed in the application form, and that banks must inform the all in cost to the customer so it can be compared with other sources of finance. Banks should also devise a system of acknowledging receipt of all loan applications. Our guide to the Key Facts Statement and its all charges disclosure shows the document where much of this now appears side by side.

What should the sanction letter and agreement contain?

Clear terms you have actually accepted. Under the heading on loan appraisal, the guidelines say lenders should not use margin and security stipulations as a substitute for due diligence on the borrower's creditworthiness. They should convey the credit limit along with its terms and conditions, and keep on record the borrower's acceptance of those terms given with full knowledge.

Terms arrived at after negotiation should be reduced to writing and certified by an authorised official. The guidelines also say the agreement should, as far as possible, spell out which facilities are solely at the lender's discretion. Read those clauses closely, because they describe what the bank can refuse later without breaching the agreement.

What happens if your application is rejected?

You should get the reasons in writing. The guidelines say that in all categories of loans, irrespective of any threshold limits, lenders should convey in writing the main reason or reasons which, in the bank's opinion after due consideration, led to rejection of the application, within the stipulated time.

They also say banks should verify applications within a reasonable period, inform borrowers immediately if more details or documents are needed, and lay down a procedure for disposal of loan proposals with appropriate timelines, which they may disclose on websites, notice boards and product literature. For a buyer with a booking deadline, that means two practical questions at the start: what is your timeline for a credit decision, and will you put any rejection reason in writing? Our earlier piece on common reasons Bengaluru home loans get rejected can help you anticipate issues before you apply.

How do the code's key promises compare?

The table pulls the main guidelines into one view, with the buyer action that goes with each. The first two columns restate the circular; the last three are practical steps.

StageWhat the guidelines sayWhat to ask forWhen to askKeep on file
ApplicationAcknowledge receipt of all loan applications; disclose all fees, refundable amounts and the all in costWritten acknowledgement and fee scheduleWhen you submitAcknowledgement and fee disclosure
RejectionConvey the main reasons in writing for all loans, within the stipulated timeWritten reasons and refund position on feesAs soon as you are toldRejection letter

Takeover by another lenderConvey consent or objection within 21 days of receiving the transfer requestDated copy of your transfer requestWhen you or the new bank applyRequest and the 21 day response

What protections apply after the loan is disbursed?

Several. The guidelines say lenders should ensure timely disbursement of sanctioned loans in line with the sanction terms, give notice of any change in terms and conditions including interest rates and service charges, and ensure that changes in interest rates and charges are effected only prospectively.

Before recalling or accelerating payment or seeking additional security, lenders should give notice as specified in the loan agreement, or a reasonable period if the agreement is silent. Lenders should release all securities on receiving payment of the loan, subject to any legitimate right or lien for another claim, in which case borrowers must be given notice with full particulars. The guidelines also say lenders must not discriminate on grounds of sex, caste and religion, and should not resort to undue harassment in recovery.

Balance transfers get a specific deadline. The guidelines say that when a request for transfer of a loan account is received, either from the borrower or from a bank proposing to take over the account, the existing lender should convey its consent or objection within 21 days from the date of receipt of the request.

If you are moving a loan on a flat, for example in a Sarjapur Road project such as Prestige Garden Breez or anywhere else in Bengaluru, keep a dated copy of your request so the 21 day clock has a clear starting point.

A seven-point checklist for Bengaluru loan applicants

  1. Ask each bank for a copy of its Fair Practices Code before you apply.
  2. Get a written acknowledgement when you submit your application.
  3. Ask for the full fee schedule, including what is refundable if the loan is not sanctioned.
  4. Ask the bank's timeline for a credit decision and note the date.
  5. If rejected, ask for the main reasons in writing before you apply elsewhere.
  6. At sanction, ask for the full loan agreement with every enclosure quoted in it.
  7. For a takeover, keep a dated copy of the request and watch the 21 day window.

Where do you go if the bank does not follow its code?

Start inside the bank. The circular says boards should lay down a grievance redressal mechanism under which disputes arising from decisions of the lender's functionaries are heard and disposed of at least at the next higher level. Write to the branch first, then escalate in writing to the next level, quoting the specific guideline you believe was not followed.

One caveat on dates: this Master Circular is dated July 1, 2015, and RBI has issued further instructions since then, such as the Key Facts Statement circular of April 15, 2024 that the 2025 housing finance circular lists in its fair lending section. Ask your bank which version of its code currently applies, and keep every written exchange.

Frequently asked questions

Must a bank tell me why my home loan was rejected?

RBI's Fair Practices Code guidelines, in its July 1, 2015 Master Circular on loans and advances, say that for all categories of loans, irrespective of threshold, lenders should convey in writing the main reason or reasons that led to rejection of the loan application, within the stipulated time.

Can a bank add charges it did not disclose when I applied?

The same guidelines say levying charges later without disclosing them to the borrower is an unfair practice, and that all fees and charges for processing should be disclosed in the loan application form. Banks must also inform the all in cost so you can compare it with other sources of finance.

How long can my bank take to respond to a takeover request?

Under the guidelines, when a request to transfer a loan account is received from the borrower or from a bank proposing to take it over, the existing lender should convey its consent or objection within 21 days from the date of receipt of the request.

Am I entitled to a copy of my loan agreement?

Yes. The guidelines say banks should invariably furnish a copy of the loan agreement, along with a copy each of all enclosures quoted in it, to all borrowers at the time of sanction or disbursement. Ask for the full set, including schedules, before you sign the final papers.
