Interest From Disbursement, Not Sanction: Checking Every Home Loan Tranche on a Bengaluru Flat

In an April 2024 circular, the RBI flagged lenders charging interest from the sanction or agreement date instead of the actual disbursement, and from cheque dates before handover. For Bengaluru buyers paying a builder in construction linked tranches, here is how to check every disbursement.

Buy an under construction flat in Bengaluru on a construction linked plan and your bank may not hand over the full loan on day one. It can pay the builder in instalments as construction reaches each stage, with interest due only on what has been disbursed. That is the theory. In April 2024, the Reserve Bank of India said its examinations had found lenders charging interest in ways that did not match it, including from dates before the money actually left the bank.

The RBI's circular on the Fair Practices Code for Lenders, Charging of Interest, dated April 29, 2024, was addressed to commercial banks, cooperative banks and non banking financial companies including housing finance companies. For a buyer on a construction linked plan, with five, eight or more disbursements over the life of the project, it is a useful checklist for reading every statement.

The short answer. The RBI's April 2024 circular listed four practices it had observed: charging interest from the sanction or agreement date instead of the actual disbursal; charging from the cheque date when the cheque was handed over days later; charging for the entire month on a mid month disbursal or repayment; and collecting instalments in advance while charging interest on the full loan. It directed lenders to review their practices, encouraged online transfers in place of cheques, and advised refunds of excess interest found. The trade-off for buyers: checking each tranche takes some time with every statement, but on a large loan even a few days of extra interest per tranche adds up over a long construction period.

What did the RBI find lenders doing?

The circular says the RBI's onsite examinations found instances of unfair practices in charging interest. It lists them specifically. First, charging interest from the date of sanction of the loan or the date of execution of the loan agreement, instead of from the date of actual disbursement of funds. Second, in cases where loans were disbursed by cheque, interest was charged from the date of the cheque, whereas the cheque was handed over to the customer several days later.

Third, where a loan was disbursed or repaid during a month, some lenders charged interest for the entire month rather than only for the period the loan was outstanding. Fourth, some lenders collected one or more instalments in advance but still reckoned the full loan amount for charging interest.

What did the RBI ask lenders to do about it?

The circular directs all regulated entities to review their practices regarding the mode of disbursal of loans, application of interest and other charges, and to take corrective action, including system level changes, as may be necessary. It encourages them to use online account transfers in lieu of cheques when disbursing loans. Where the practices came to light, the RBI says it advised lenders to refund the excess interest and other charges to customers.

The circular is a supervisory communication that describes observed practices and the RBI's expectations. If you find a mismatch on your own loan, the first step is to raise it with your lender in writing, citing the disbursement date and the interest start date.

How do construction linked tranches work on a typical Bengaluru flat?

Under a construction linked plan, the builder raises a demand when a construction stage is reached, and you pay it from your own contribution, the bank's disbursement, or both. The RERA Act shapes the paperwork behind this. Section 11(3)(b) requires the promoter, at booking, to make available the stage wise time schedule of completion, and Section 13(2) requires the agreement for sale to specify the dates and manner of payments. The text is in the Gazette copy of the RE(R&D) Act, 2016 hosted on the Telangana RERA portal.

Each disbursement starts a new amount on which interest runs. Until full disbursement, a loan may charge only interest on the disbursed amount, often called pre EMI. Our earlier piece on pre EMI costs across construction tranches at a 5.50% repo rate works through how that interest builds up, and our comparison of construction linked and subvention payment plans covers the trade-offs between plan types.

How much can a few days of extra interest cost?

More than it looks, when repeated across tranches. Take an illustrative loan at 8.50% a year. A first tranche of Rs 20 lakh carries simple interest of about Rs 14,167 a month. If interest were charged from a date 10 days before the money was actually disbursed, the extra would be about Rs 4,658 on that tranche alone. Twenty days would mean about Rs 9,315, and a full 30 days about Rs 13,973.

On a larger tranche, the numbers scale up. Once Rs 60 lakh is outstanding, a month's interest at the same rate is about Rs 42,500, and at Rs 80 lakh it is about Rs 56,667. A loan with eight tranches and a few days of mismatch on each could add up to a noticeable sum over a two to three year construction period. These figures are illustrations; your rate, tranche sizes and calculation method will differ.

What should I compare on each loan statement?

Three dates and one amount. The first date is the one on the builder's demand letter for the stage. The second is the date your bank actually transferred the money to the builder's account, which should appear on the disbursement advice or your loan account statement. The third is the date from which interest on that tranche begins. The amount is the interest charged for the first partial month after the disbursement.

If the interest start date is earlier than the transfer date, or if the first partial month shows interest for the whole month, ask the lender to explain the calculation. If the loan was disbursed by cheque or demand draft, note the date the instrument was actually handed over to the builder as well as the date printed on it. If you paid any instalments in advance, check that interest is computed on the reduced balance.

Keep the builder's receipts too. Section 19(6) of the RERA Act makes you responsible for paying in the manner and time specified in the agreement for sale, so a clean record of demand dates, disbursement dates and receipts protects you on both sides of the transaction. Our guide on the difference between a sanction letter and disbursement explains why the sanction date itself does not start your interest clock.

When you track progress against the stage schedule, a PropNewz project profile such as Sumadhura Solea in Rachenahalli can help you follow a project, but the builder's demand letters and your loan statements are the documents that matter for this check.

What if I paid an instalment in advance or the lender does not correct a mismatch?

Advance payments are the fourth practice in the RBI's list. The circular says some lenders collected one or more instalments in advance but reckoned the full loan amount for charging interest. If you paid an EMI or a lump sum ahead of schedule, for example to bring forward a stage payment or after receiving a bonus, check that the next statement computes interest on the reduced outstanding balance rather than on the original figure.

If you raise a mismatch and the explanation does not resolve it, keep the trail in writing: the demand letter, the disbursement advice, the statement showing the interest start date, your letter to the lender and its reply. Escalate through the lender's grievance redressal process first. Our explainer on the RBI Ombudsman Scheme 2026 and home loan complaints explains which lenders that route covers.

The same discipline also helps at the end of the loan. A complete file of disbursement dates and interest start dates makes it easier to reconcile the final interest certificate and the closure statement, so any small gaps can be raised while records are fresh.

What should I do with every disbursement?

Use the same seven steps each time the builder raises a stage demand.

  1. Check the demand letter against the stage wise schedule and the payment terms in your agreement for sale.
  2. Request disbursement through an online account transfer rather than a cheque where your lender allows it.
  3. Save the disbursement advice showing the date the money reached the builder's account.
  4. Collect the builder's receipt for the amount, with the date and the stage it relates to.
  5. On the next statement, confirm interest on the new tranche starts from the actual disbursement date.
  6. Check that a mid month disbursement is charged interest only for the days it was outstanding.
  7. If anything does not match, write to the lender with the dates and ask for the calculation or a correction.

Frequently asked questions

From which date should home loan interest start on a tranche?

In its April 29, 2024 circular on charging of interest, the RBI listed charging interest from the date of sanction or the date of execution of the loan agreement, rather than the actual disbursal, as a practice it observed and directed lenders to review. Compare each tranche's interest start date with its disbursement date.

What did the RBI say about cheque disbursements?

The RBI's April 2024 circular said it found cases where interest was charged from the date of the cheque even though the cheque was handed over to the customer several days later. It encouraged lenders to use online account transfers in lieu of cheques for disbursing loans.

Can a lender charge a full month's interest if money was disbursed mid month?

The RBI's April 2024 circular listed charging interest for the entire month on a mid month disbursal or repayment, rather than only for the period the loan was outstanding, as a practice it observed. Check the interest on your first statement after each disbursement against the actual number of days.

How do RERA payment stages connect to my loan tranches?

Section 13(2) of the RERA Act requires the agreement for sale to specify the dates and manner of payments, and Section 11(3)(b) requires a stage wise completion schedule at booking. If your bank disburses against the builder's stage demands, these documents help you match each tranche to a construction stage.
